Senators HUTTO and MATTHEWS proposed the following amendment (214R003.CBH):
Amend the bill, as and if amended, page 8, by striking lines 5-7 and inserting:
/
(7) has committed dishonorable, unethical, or unprofessional conduct that is likely to deceive, defraud, or harm the public;
(8)(7) lacks the professional or ethical competence to practice massage/bodywork;
(9)(8) has been convicted of or has pled guilty to or nolo contendere to a violent crime as defined in Section 16-1-60, during the previous five years has been convicted of or has pled guilty to or nolo contendere to a felony
or a crime which that directly relates to the practice or ability to practice massage/bodywork
, or during the previous seven years has been convicted of or has pled guilty to or nolo contendere to a felony, an essential element of which is dishonesty, that reasonably relates to the ability to practice massage/bodywork;
(10)(9) has practiced massage/bodywork while under the influence of alcohol or drugs or uses alcohol or drugs to such a degree as to render him
or her unfit to practice massage/bodywork;
(11)(10) has sustained a physical or mental disability, as determined by a physician
, which that renders further practice by the licensee dangerous to the public. /
