Amend the bill, as and if amended, Part IB, Section 34, DEPARTMENT OF HEALTH & ENVIRONMENTAL CONTROL, page 413, by adding an appropriately numbered new proviso to read:
/ 34.___ (DHEC: Solid Waste Management Facilities) The department shall charge each solid waste management facility operator a fee of ten dollars for each ton (1) of the maximum tonnage rate for Fiscal Year 2013-14 for each solid waste management facility permitted during the fiscal year or (2) of the expanded portion of the maximum tonnage rate for Fiscal Year 2013-14 from an existing solid waste management facility expansion permitted during the fiscal year. The fee must be placed in a separate account maintained by the State Treasurer to be expended only to mitigate environmental damage and compensate local residents for damages resulting from the operation of the proposed or expanded facilities. The department may carry forward any unexpended funds. The provisions of this proviso apply to all Class I, Class II, Class III, and other landfills and the fees shall be due from the Class I, Class II, Class III, and other landfill operators. /
