Reference is to the bill as introduced.
Amend the bill, as and if amended, by striking all after the enacting words and inserting:
/ SECTION 1. Chapter 5, Title 56 of the 1976 Code is amended by adding:
"Section 56-5-35.
(A) A political subdivision, county,
or municipality may not impose a fine for a violation of a local
traffic ordinance, rule, or regulation that exceeds one hundred
fifty percent of the maximum fine that may be imposed in this
chapter for a traffic violation, the elements of which are the
same, or substantially the same, as the local traffic violation.
If however, the political subdivision, county, or municipality
collects a fine that exceeds one hundred fifty percent of the
amount of the maximum fine allowed for that violation in this
chapter, the political subdivision, county, or municipality
shall remit to the State Treasurer to be credited to the state
general fund the amount of excess fine collected.
(B) This section does
not preclude a political subdivision, county, or municipality
from charging and collecting a court cost, assessment, or
surcharge in connection with a local traffic violation."
SECTION 2. This act takes effect upon approval by the Governor. /
