Rep. MERRILL proposes the following Amendment No. to H.3701 as introduced by Ways & Means

EXPLANATION: Provides that funds shall be used if the Army Corps documents a direct impact from Charleston Harbor deepening to areas renourished within the last two years and adjacent to the federal channel

Amend the bill, as and if amended, Part IB, Section 88, STATE PORTS AUTHORITY, page 487, paragraph 88.6, lines 11 - 12, by striking the proviso in its entirety and adding an appropriately numbered paragraph to read: /(SPA: Charleston Harbor Downdrift mitigation) Of the funds authorized for the State Ports Authority for Fiscal Year 2015-16 for Harbor Deepening, $300,000 shall be used for Charleston Harbor downdrift renourishment mitigation if the U.S. Army Corps of Engineers' Record of Decision documents an impact from the -52 MLLW project to a beach area which has renourished within the last two years and is adjacent to the federal channel.
