The Committee on Medical, Military, Public and Municipal Affairs proposes the following Amendment No. 1 to H. 3438 (COUNCIL\VR\3438C001.CC.VR17):

Amend the bill, as and if amended, Section 40-43-30(28), as contained in SECTION 4, page 7, is amended by striking the item in its entirety and inserting:

/      (28)      'Interchangeable biological product' means a biological product that the federal Food and Drug Administration has:
           (a)      licensed and determined to meet the standards of 'interchangeability' pursuant to 42 U.S.C. Sec. 262(k)(4); or
           (b)      determined to be therapeutically equivalent by the federal Food and Drug Administration. /
