Amend the bill, as and if amended, by adding an appropriately numbered SECTION to read:
/ SECTION ___. A. Chapter 1, Title 11 of the 1976 Code is amended by adding:
"Section 11-1-130.
(A) If the state, a municipality,
county, or other political subdivision appropriates public funds
or makes grant of public funds by name to an entity operating in
this State as a domestic or foreign nonprofit corporation, then
the nonprofit corporation must submit to the appropriating or
granting jurisdiction an expenditure report. Before providing
any monies to the nonprofit corporation, the appropriating or
granting jurisdiction must obtain from the nonprofit corporation
a written agreement to submit the expenditure reports required
by this section. The expenditure report must be submitted
annually and until all monies received from the appropriation or
grant have been expended. A final expenditure report is due to
the appropriating or granting jurisdiction not later than one
hundred twenty days after all monies received from the
appropriation or grant have been expended.
(B)(1) The expenditure
reports required by this section are in addition to any
documentation that may be required by the state agency,
municipality, county, or other political subdivision to disburse
public funds.
(2)
The expenditure report required by the section must be
limited to and contain:
(a)
the name and address of the reporting nonprofit
corporation, including the nonprofit corporation's web
address;
(b)
a description of the purpose of the appropriation or
grant;
(c)
the total dollar amount of the appropriation or grant;
(d)
the total dollar amount of the appropriation or grant
expended as of the date of the expenditure report;
(e)
the dollar amount expended as of the date of the
expenditure report by budget category, using the budget
categories as used in the state's annual general appropriations
bill or by budget categories substantially similar to the budget
categories used in the state's annual general appropriations
bill.
(C) The expenditure
reports required by this section must be made available to the
public by the appropriating or granting jurisdiction. The
nonprofit corporation shall direct requests for a copy of the
expenditure report to the appropriating or granting
jurisdiction. A nonprofit corporation that receives appropriated
public funds or a grant of public funds for which the nonprofit
corporation is required to submit an expenditure report pursuant
to this section is exempt from the provisions of Chapter 4,
Title 30, unless the nonprofit corporation is subject to the
provisions of Chapter 4, Title 30, for reasons other than the
receipt of appropriated public funds or a grant of public funds
for which the nonprofit corporation is required to file an
expenditure report.
(D) The submission of
expenditure reports, as required in subsection (A) of this
section, is not required for public funds received as payment
from a state agency, municipality, county, or other political
subdivision in return for supplying specific goods or services
as part of an arms-length transaction. For purposes of this
subsection, 'goods or services' includes, but not limited to,
membership fees, dues, and subscriptions."
B. This act takes effect upon approval by the Governor and applies to any appropriations and grants of public funds received thereafter and within three calendar years thereof. /
