View Amendment Current Amendment: 1a to Bill 5399

Rep. COBB-HUNTER proposes the following Amendment No. to H. 5399 (COUNCIL\VR\5399C046.CC.VR22):

Amend the bill, as and if amended, by striking the bill in its entirety and inserting:

/ A JOINT RESOLUTION

PROPOSING AN AMENDMENT TO SECTION 10, ARTICLE I OF THE CONSTITUTION OF SOUTH CAROLINA, 1895, RELATING IN PART TO THE RIGHT TO BE FREE FROM UNREASONABLE INVASIONS OF PRIVACY, SO AS TO PROVIDE THAT THE RIGHT OF PEOPLE TO BE SECURE IN THEIR PERSONS AGAINST UNREASONABLE INVASIONS OF PRIVACY INCLUDES A LIMITED RIGHT TO ABORTION HEALTH CARE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. It is proposed that Section 10, Article I of the Constitution of this State be amended to read:

"Section 10.The right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures and unreasonable invasions of privacy shall not be violated, and no warrants shall issue but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, the person or thing to be seized, and the information to be obtained. The right of the people to be secure in their persons against unreasonable invasions of privacy includes, but is not limited to, a limited right to abortion health care."

SECTION2. The proposed amendment must be submitted to the qualified electors at the general election for representatives in 2024. Ballots must be provided at the various voting precincts with the following words printed or written on the ballot:

"Must Section 10, Article I of the Constitution of this State, relating in part to the right to be free from unreasonable invasions of privacy, be amended so as to provide that the right of the people to be secure in their persons against unreasonable invasions of privacy includes, but is not limited to, a limited right to abortion health care?

Those voting in favor of the question shall deposit a ballot with a check or cross mark in the square after the word 'Yes', and those voting against the question shall deposit a ballot with a check or cross mark in the square after the word 'No'." /
