A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-6-75 SO AS TO PROHIBIT THE SOUTH CAROLINA DEPARTMENT OF HEALTH AND HUMAN SERVICES FROM ESTABLISHING, FACILITATING, IMPLEMENTING, OR PARTICIPATING IN THE EXPANSION OF MEDICAID ELIGIBILITY UNDER THE FEDERAL PATIENT PROTECTION AND AFFORDABLE CARE ACT OF 2010.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 6, Title 44 of the 1976 Code is amended by adding:

"Section 44-6-75.    Notwithstanding any other provision of law, the department shall not establish, facilitate, implement, or participate in the expansion of Medicaid eligibility under the federal Patient Protection and Affordable Care Act of 2010, P.L. 111-148."

SECTION    2.    This act takes effect upon approval by the Governor.
