AN ACT TO PROVIDE THAT ANY STATE EMPLOYEE, WHO IS INJURED AS A RESULT OF CRIMINAL CONDUCT OF ANOTHER WHILE ENGAGED IN ASSIGNED DUTIES AS A STATE LAW ENFORCEMENT OFFICER OR AS AN EMPLOYEE OF ANY STATE CORRECTIONAL INSTITUTION AND SUCH INJURY RENDERS SUCH PERSON INCAPABLE OF PERFORMING HIS WORK AS A STATE EMPLOYEE, SHALL CONTINUE TO RECEIVE FULL STATE COMPENSATION FOR A PERIOD OF ONE YEAR OR SUCH LESSER PERIOD AS INCAPACITY CONTINUES WITHOUT PREJUDICE TO HIS RIGHT TO OBTAIN WORKMEN'S COMPENSATION BENEFITS IN APPROPRIATE CIRCUMSTANCES.

Be it enacted by the General Assembly of the State of South Carolina:

Law Enforcement Officers to Receive Compensation

Section 1. Notwithstanding any other provisions of law including specifically Title 42 of the 1976 Code, when any law enforcement officer employed by the State or any other state employee employed by a state correctional institution or agency including the Department of Youth Services is injured, while engaged in his state employment, by the criminal conduct of another and such injury is so severe that the employee is incapable of performing his work as a state employee, such employee shall continue to receive full state compensation including all employee benefits for a period of one year from the date of injury or such lesser period as his incapacity continues. At the end of one year, if his incapacity continues, such employee shall be eligible to apply for and in a proper case receive workmen's compensation benefits in the same manner he would have been eligible therefor if the date of his injury had been the date of the expiration of the one-year period except that he shall not receive workmen's compensation benefits for the one year during which he continued to receive full state compensation.

The Comptroller General and the Industrial Commission shall establish procedures and if necessary promulgate regulations to implement the provisions of this act.

Time effective

Section 2. This act shall take effect upon approval by the Governor.
