AN ACT TO AMEND SECTIONS 44-53-190, 44-53-210, 44-53-230, AND 44-53-250, ALL AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CONTROLLED SUBSTANCES, SO AS TO ADD ALPHAMETHYLFENTANYL, FENETHYLLINE, AND N-ETHYLAMPHETAMINE TO SCHEDULE I, TO INCLUDE THE GENERIC NAME MEPERIDINE OPPOSITE PETHIDINE IN SCHEDULE II, TO MOVE MAZINDOL FROM SCHEDULE III TO SCHEDULE IV, AND TO ADD ALPRAZOLAM TO SCHEDULE IV.

Be it enacted by the General Assembly of the State of South Carolina:

Controlled substances added

Section 1. Subsection (b) of Section 44 53-190 of the 1976 Code, as last amended by Act 72 of 1981, is further amended by adding:

"47. Alphamethylfentanyl (N-[1-(alpha-methyl-beta-phenyl) ethyl-4-piperidyl] propionanilide; 1-(1-methyl-2-phenylethyl-4-(N-propanilido) piperidine)."

Further

Section 2. Section 44-53-190 of the 1976 Code, as last amended by Act 72 of 1981, is further amended by adding:

"(f) Stimulants. Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation which contains any quantity of the following substances having a stimulant effect on the central nervous system, including its salts, isomers, and salts of isomers:

(1) Fenethylline.

(2) N-ethylamphetamine."

Generic name added

Section 3. Item 15 of subsection (c) of Section 44-53-210 of the 1976 Code is amended to read:

"15. Pethidine (meperidine)."

Controlled substance deleted

Section 4. Section 44-53-230 of the 1976 Code, as last amended by Act 118 of 1979, is further amended by deleting item (4) of subsection (b) which reads:

"4. Mazindol".

Controlled substance added

Section 5. Section 44-53-250 of the 1976 Code, as last amended by Act 72 of 1981, is further amended by striking subsections (a) and (b) and inserting:

"(a) Depressants. Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation which contains any quantity of the following substances having a depressant effect on the central nervous system, including its salts, isomers (whether position, geometric, or optical), and salts of such isomers whenever the existence of such salts, isomers, and salts of isomers is possible within the specific chemical designation:

(1) Alprazolam

(2) Barbital

(3) Chloral Betaine

(4) Chloral Hydrate

(5) Chlordiazepoxide

(6) Clonazepam

(7) Clorazepate

(8) Diazepam

(9) Ethchlorvynol

(10) Ethinamate

(11) Flurazepam

(12) Halazepam

(13) Lorazepam

(14) Mebutamate

(15) Meprobamate

(16) Methohexital

(17) Methylphenobarbital

(18) Oxazepam

(19) Paraldehyde

(20) Petrichloral

(21) Phenobarbital

(22) Prazepam

(23) Temazepam.

(b) Stimulants. Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation which contains any quantity of the following substances having a stimulant effect on the central nervous system, including its salts, isomers (whether position, geometric, or optical), and salts of such isomers whenever the existence of such salts, isomers, and salts of isomers is possible within the specific chemical designation:

(1) Diethylpropion

(2) Mazindol

(3) Phentermine

(4) Pemoline, including organometallic complexes and chelates thereof.

(5) Pipradol

(6) SPA [(-)-1-Dimethylamino-1, 2-diphenylethane]".

Time effective

Section 6. This act shall take effect upon the approval by the Governor.
