TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 14-17-545 SO AS TO PROVIDE THAT THE CLERKS OF COURT SHALL MAINTAIN A BOOK RECORDING SENTENCES IMPOSED UPON CONVICTION IN EACH CRIMINAL CASE LISTED BY THE JUDGE PRESIDING.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 14-17-545. (A) In addition to the Court of General Sessions Journal required by Section 14-17-540, the clerks of court shall maintain a journal containing the name of each judge presiding in general sessions, all criminal convictions over which the judge has presided, in chronological order beginning on or after July 1, 1991, and including the following additional information:
(1) name of the case;
(2) charges against the defendant;
(3) charges of which the defendant was convicted;
(4) sentence handed down by the judge; and
(5) date the sentence was handed down.
(B) The journal is a public record of the State and must be available for inspection at the office of the clerk during regular office hours and at other times as may be provided by law."
SECTION 2. This act takes effect upon approval by the Governor.
