TO AMEND ARTICLE 33, CHAPTER 3, TITLE 56, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO SPECIAL LICENSE PLATES FOR PURPLE HEART RECIPIENTS, SO AS TO PROVIDE FOR FREE VEHICULAR REGISTRATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 33, Chapter 3, Title 56 of the 1976 Code, as last amended by Act 181 of 1993, is further amended to read:
Section 56-3-3310. A recipient of the Purple Heart award by the United States Armed Forces who is a legal resident of this State may apply for registration and licensing of his personal motor vehicle or truck, not exceeding three-quarter ton, to the department without paying the usual fee for registration and licensing of a vehicle of similar type. The department may shall issue a special motor vehicle license plate to a recipient of the Purple Heart and revalidation sticker upon receipt of the application made under oath and in a form required by the department. The provisions of this section do not apply if the Purple Heart recipient applies for a special personalized motor vehicle license plate under other provisions of this chapter. Only one plate may be issued to a person. The biennial fee for the special license plate is the same as the fee provided for in Section 56-3-2020 and only one plate may be issued to any person. The application for a special plate must include proof that the applicant is a recipient of the Purple Heart.
Section 56-3-3320. The special license plates must be of the same size as regular motor vehicle license plates, upon which must be imprinted on the left side of the plates the distinctive Purple Heart insignia with numbers and designs determined by the department. The license plate must be issued for an annual period which shall expire twelve months from the month in which the special license plate is issued.
Section 56-3-3330. A license plate issued pursuant to this article may be transferred to another vehicle of the same weight class owned by the same person upon application being made and approved by the department. It is unlawful for any person to whom the special plate has been issued to knowingly permit it to be displayed on any vehicle except other than the one authorized by the department.
Section 56-3-3340. The provisions of this article do not affect the registration and licensing of motor vehicles as required by other provisions of this chapter but are cumulative to them. Any A person violating who violates the provisions of this article or any person who (a)(1) fraudulently gives false or fictitious information in any an application for a special license plate, as authorized in this article,; (b)(2) conceals a material fact,; or (c)(3) otherwise commits a fraud in any an application or in the use of any a special license plate issued is guilty of a misdemeanor and, upon conviction, must be punished by a fine of fined not more than one hundred dollars or by imprisonment for imprisoned not more than thirty days."
SECTION 2. This act takes effect upon approval by the Governor.
