TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-55-42 SO AS TO EXEMPT FROM REGULATION TEMPORARY SHALLOW GROUNDWATER WELLS USED SOLELY FOR JURISDICTIONAL DETERMINATION OF FEDERAL 404 WETLANDS AS PART OF AN APPROVED ARMY CORPS OF ENGINEERS' PLAN.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 44-55-42. The requirements of Section 44-55-40 and related regulations do not apply to temporary shallow groundwater wells used solely for jurisdictional determination of federal 404 wetlands as part of an approved Army Corps of Engineers' plan."
SECTION 2. This act takes effect upon approval by the Governor.
