TO APPROVE REGULATIONS OF THE DEPARTMENT OF LABOR, LICENSING AND REGULATION, RELATING TO FAILURE TO APPEAR AT HEARING BEFORE THE OCCUPATIONAL HEALTH AND SAFETY REVIEW BOARD, DESIGNATED AS REGULATION DOCUMENT NUMBER 1743, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Department of Labor, Licensing and Regulation, relating to Failure to Appear at Hearing Before the Occupational Health and Safety Review Board, designated as Regulation Document Number 1743, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.
SUMMARY AS SUBMITTED BY PROMULGATING AGENCY.
The proposed amendment provides that a party who fails to appear at a hearing scheduled before a member of the South Carolina Occupational Health and Safety Review Board in order to resolve that party's Notice of Protest of a citation, proposed penalty, or period of abatement may be taxed $100 to cover the costs of the hearing. The costs will not be taxed if the Board Member grants, for good cause shown, a timely petition for reinstatement of the matter.
