A JOINT RESOLUTION TO DIRECT THE CLEMSON UNIVERSITY LIVESTOCK-POULTRY HEALTH DIVISION TO ESTABLISH A QUARANTINE FOR LARYNGOTRACHEITIS, AN INFECTIOUS AND COMMUNICABLE POULTRY DISEASE, AND TO PROVIDE REQUIREMENTS FOR THE QUARANTINE.
Whereas, there has been an outbreak of laryngotracheitis, a highly infectious and contagious poultry disease which could have a significant impact on the poultry industry of this State. Now, therefore,
Be it enacted by the General Assembly of the State of South Carolina:
Quarantine for Laryngotracheitis
SECTION 1. (A) The Clemson University Livestock-Poultry Health Division shall establish a quarantine, as provided in this section, for laryngotracheitis, an infectious and communicable disease of poultry.
(B) Quarantined areas include counties, as designated by the State Veterinarian, outside South Carolina in which official quarantines have been imposed. The quarantined areas, which may be revised by the State Veterinarian, are effective upon filing with the South Carolina Legislative Council.
(C) Quarantined items include poultry, uncooked poultry by-products, poultry waste products including litter, manure, or any mixture containing litter or manure, crates or other shipping containers, and means of transportation by which the disease is spread.
(D) No quarantined items from the quarantined areas may enter South Carolina except as follows:
(1) Poultry may go directly to slaughter if the means of transportation proceeds directly to the slaughter plant and returns directly to the quarantined area. All other poultry must be accompanied by the appropriate certificates of veterinary inspection or National Poultry Improvement Plan certificates, or both, which must indicate the poultry is apparently free from laryngotracheitis.
(2) Poultry by-products must be rendered or shipped in sealed containers directly to renderers.
(3) Shipping containers or means of transportation, except as noted in this subsection, may enter this State only if properly cleaned and disinfected in accordance with the standards of the appropriate state animal-poultry health agency or the United States Animal and Plant Health Inspection Service.
(E) A person transporting quarantined items into South Carolina from other states shall provide, upon request of law enforcement officers or agents of the State Veterinarian, the address and telephone number of the premises of origin and the destination of the quarantined items.
(F) A person who violates this section is guilty of a misdemeanor and, upon conviction for a first offense, must be fined not more than five hundred dollars or imprisoned not more than thirty days and, upon conviction for a second offense, must be fined not more than five thousand dollars or imprisoned not more than three years.
(G) The quarantine and the requirements of this section remain in effect through June 30, 1996.
Time effective
SECTION 2. This joint resolution takes effect upon approval by the Governor.
