TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 1-3-247 SO AS TO PROVIDE THAT AN APPOINTED MEMBER OF A COUNTY OR MULTICOUNTY AUTHORITY, BOARD, COUNCIL, COMMISSION, COMMITTEE, OR DISTRICT WHO HAS THREE CONSECUTIVE UNEXCUSED ABSENCES FROM MEETINGS IS CONSIDERED REMOVED FROM OFFICE AND A VACANCY IS CREATED; TO REQUIRE THE CHAIRMAN TO IMMEDIATELY NOTIFY THE APPOINTING AUTHORITY OF THE VACANCY; AND TO PROVIDE THAT THIS SECTION DOES NOT APPLY TO EX OFFICIO MEMBERS OR THEIR DESIGNEES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 1-3-247. (A) An appointed member of a county or multicounty authority, board, council, commission, committee, or district who has three consecutive unexcused absences from meetings held by the particular authority, board, council, commission, committee, or district is considered removed from the authority board, council, commission, committee, or district and a vacancy is created. The chairman of the county or multicounty authority, board, council, commission, committee, or district must notify the appointing authority of the member's three consecutive unexcused absences and of the resulting vacancy. An unexcused absence must be defined by each respective county or multicounty authority, board, council, commission, committee, or district in rules governing its own operation.
(B) This section does not apply to an ex officio member of an authority, board, council, commission, committee, district, or to a designee of ex officio member."
SECTION 2. This act takes effect upon approval by the Governor.
