TO AMEND SECTION 41-10-60, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PAYMENT OF WAGES WHEN THE AMOUNT DUE IS IN DISPUTE, SO AS TO PROVIDE THAT AN EMPLOYER MAY WITHHOLD PAYMENT OF WAGES FOR THREE DAYS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 41-10-60 of the 1976 Code is amended to read:
"Section 41-10-60. Notwithstanding the provisions of Section 40-10-30 or any other provision of law, In in case of a dispute over wages, the employer may withhold payment of wages for three days; thereafter the employer shall give written notice to the employee of the amount of wages which he concedes to be due and shall pay the amount without condition within the time set by this chapter. Acceptance by the employee of the payment does not constitute a release as to the balance of his claim."
SECTION 2. This act takes effect upon approval by the Governor.
