A BILL

TO AMEND SECTION 30-4-40, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE ENUMERATED MATTERS EXEMPT FROM DISCLOSURE UNDER THE STATE FREEDOM OF INFORMATION LAW, SO AS TO PROVIDE FOR THE EXEMPTION FROM DISCLOSURE OF THE IDENTITY OF ANY INDIVIDUAL WHO, IN GOOD FAITH, MAKES A COMPLAINT OR OTHERWISE DISCLOSES INFORMATION, WHICH ALLEGE A VIOLATION OF LAW OR REGULATION, TO A STATE REGULATORY AGENCY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 30-4-40(a) of the 1976 Code, as last amended by Act 458 of 1996, is further amended by adding an appropriately numbered item to read:

"( ) the identity, or information tending to reveal the identity, of any individual who, in good faith, makes a complaint or otherwise discloses information, which alleges a violation or potential violation of law or regulation, to a state regulatory agency."

SECTION 2. This act takes effect upon approval by the Governor.
