A BILL

TO AMEND SECTION 35-1-180, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO LAWS GOVERNING APPLICATION OF THE UNIFORM SECURITIES ACT, SO AS TO INCLUDE AN OPT-OUT PROVISION IN ACCORDANCE WITH THE PHILANTHROPY PROTECTION ACT OF 1995, PUBLIC LAW 104-62, AND MAKING IT EFFECTIVE DECEMBER 1, 1998.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 35-1-180 of the 1976 Code, as last amended by Act 134 of 1997, is further amended by adding:

"(7) In accordance with Section 6(c) of the Philanthropy Protection Act of 1995, Public Law 104-62, to the extent a provision of this chapter would be affected otherwise by that act, the provision may not be preempted by that act."

SECTION 2. This act takes effect December 1, 1998.
