A BILL

TO AMEND TITLE 60 OF THE CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO LIBRARIES, ARCHIVES, MUSEUMS, AND ARTS, BY ADDING CHAPTER 14 SO AS TO ESTABLISH THE SOUTH CAROLINA CONFEDERATE MUSEUM.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Title 60 of the 1976 Code is amended by adding:

"CHAPTER 14

South Carolina Confederate Museum

Section 60-14-10. There is hereby established within the State Budget and Control Board the South Carolina Confederate Museum. Legal title or control of all artifacts, relics and historical records that relate to the period of the War Between the States titled to or under the control of the Confederate Relic Room must be transferred to the museum. The General Assembly must provide for the maintenance and support of the museum in the annual general appropriation act and may provide such other support it deems appropriate.

Section 60-14-20. (A) To plan and administer the museum, there is hereby created the South Carolina Confederate Museum Committee.

(B) The committee must be composed of the following five members:

(1) the South Carolina Division Commander of the Sons of the Confederate Veterans or his designee;

(2) the President of the South Carolina Chapter of the United Daughters of the Confederacy or her designee; and

(3) three members appointed by the Governor from the state at-large.

(C) The committee members identified in items (1) and (2) of subsection (B) must serve terms coterminous with their terms in office. The members appointed by the Governor must serve terms of two years and until their successors are appointed and qualify.

(D) The committee must hold regular meetings, prescribe rules for its operations, elect such officers as are necessary, establish and use any identifying seal pertaining to museum business, and make an annual report to the General Assembly. For the purpose of transacting business, three members shall constitute a quorum. The members of the committee must serve without compensation.

Section 60-14-30. The executive director of the Budget and Control Board must appoint a museum director to carry out the functions of the museum. The museum director shall serve at the pleasure of the executive director of the Budget and Control Board.

Section 60-14-40. The museum may accept lands, buildings, money, relics, weapons, or any other thing of value on behalf of, or as additions to, the museum, either in the form of loans or grants or donations or bequests; may acquire land and items by purchase, lease, or otherwise; and may enter into contracts with any person to accomplish such purposes. Any such gifts, donations or bequests must be deemed to be gifts to a charitable or eleemosynary organization. Donated funds may be expended to restore, preserve, and display the museum collection.

Section 60-14-50. (A) The museum must be a military and historical museum charged with the responsibility for the collection, preservation, and exhibition of archives, books, records, documents, maps, charts, military equipment, uniforms, flags, and any other such articles which relate to the period of the War Between the States. The museum must be open to the public at such times as may be determined by the director.

(B) The museum is authorized to collect, retain, and expend fees from research and photographic processing requests and from the sale of promotional items.

(C) No artifacts owned by the State in the collection and exhibits of the South Carolina Confederate Museum shall be permanently removed or disposed of except by a concurrent resolution of the General Assembly."

SECTION 2. This act takes effect upon approval by the Governor.
