TO PROHIBIT THE OPERATION OF MORE THAN FIVE COIN-OPERATED DEVICES LICENSED PURSUANT TO SECTION 12-21-2720(A)(3), CODE OF LAWS SOUTH CAROLINA, 1976, AT ANY ESTABLISHMENT, LOCATION, PREMISES OR STRUCTURE OR ANY LOCATION, PREMISES, OR STRUCTURE SUB-DIVIDED IN ANY MANNER WHICH ALLOWS FOR MAINTENANCE AND OPERATION OF SEPARATE ESTABLISHMENTS WITHIN A LOCATION, PREMISES, OR STRUCTURE AND TO REQUIRE THE DEPARTMENT OF REVENUE TO CONFISCATE DEVICES FOUND IN EXCESS OF THE LIMIT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Notwithstanding the provisons of Sections 12-21-2728 and 12-21-2734, no establishment, location, premises or structure nor any location, premises, or structure sub-divided in any manner which allows for maintenance and operation of separate establishments within a location, premises, or structure may contain an aggregate total of more than five coin-operated devices licensed pursuant to Section 12-21-2720(A)(3). All coin-operated devices licensed pursuant to 12-21-2720(A)(3) at any establishment, location, premises or structure or any location, premises, or structure sub-divided in any manner which allows for maintenance and operation of separate establishments within a location, premises, or structure in violation of the limit contained in this act must be confiscated by the Department of Revenue.
SECTION 2. The provisions of this act are applicable to any and all establishments, locations, premises or structures or any locations, premises, or structures sub-divided in any manner which allows for maintenance and operation of separate establishments within a location, premises, or structure in operation on or after April 15, 1999.
SECTION 3. This joint resolution takes effect upon approval by the Governor.
