TO AMEND SECTION 40-59-20, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE SOUTH CAROLINA RESIDENTIAL BUILDERS COMMISSION, SO AS TO ADD A CERTIFIED HOME INSPECTOR TO THE COMMISSION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The first paragraph of Section 40-59-20 of the 1976 Code, as last amended by Act 595 of 1990, is further amended to read:
"There is hereby created the South Carolina Residential Builders Commission, hereinafter referred to as the commission. The commission must be composed of seven eight persons who shall have been residents of the State for at least five years and two of whom must be consumers not engaged in the business of residential building, one must be a certified home inspector, four of whom have been actively engaged in residential building for a period of at least five years prior to the date of their appointment, and one of whom has been actively engaged in residential specialty contracting for a period of at least five years prior to the date of his appointment. One member must be appointed from each congressional district and one two must be appointed from the State at large. Members of the commission must be appointed by the Governor with the advice and consent of the Senate for a term of four years or until their successors are appointed and qualify. Any vacancy occurring by reason of death, resignation, removal for cause, or otherwise must be filled for the remainder of the unexpired term in the same manner as provided for the original appointments. The Governor may remove any member of the commission for misconduct, incompetency, or neglect of duty."
SECTION 2. This act takes effect upon approval by the Governor.
