TO AMEND CHAPTER 111, TITLE 59, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO SCHOLARSHIPS, BY ADDING SECTION 59-111-70 SO AS TO PROVIDE THAT THE PERIOD IN WHICH AN ELIGIBLE STUDENT MUST ENROLL IN AN ELIGIBLE INSTITUTION OR TAKE ANY OTHER ACTION TO OBTAIN A STATE SPONSORED SCHOLARSHIP, TUITION ASSISTANCE, OR ANY OTHER FINANCIAL ASSISTANCE FOR SECONDARY OR POST SECONDARY EDUCATION IS TOLLED DURING ANY PERIOD THE ELIGIBLE STUDENT PERFORMS ACTIVE DUTY OR ACTIVE DUTY FOR TRAINING IN THE NATIONAL GUARD OR IN ANY BRANCH OF THE ARMED FORCES OF THE UNITED STATES, AND TO PROVIDE FOR RETROACTIVE APPLICATION OF THIS TOLLING PROVISION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 111, Title 59 of the 1976 Code is amended by adding:
"Section 59-111-70. Notwithstanding any other provision of law, the time period within which an eligible student must enroll in an eligible institution or take any other action to obtain a state sponsored scholarship, tuition assistance, or any other financial assistance for secondary or post secondary education is tolled during any period the eligible student performs active duty or active duty for training in the National Guard or in any branch of the Armed Forces of the United States. The tolling provisions of this section are retroactive in application to the inception date of each state sponsored scholarship, tuition, or financial assistance program to which this section is applicable."
SECTION 2. This act takes effect upon approval by the Governor and is retroactive in application as provided in Section 59-149-170.
