TO CREATE A COMMITTEE TO STUDY THE LAWS RELATING TO JUNIOR RESERVE OFFICER TRAINING CORPS PROGRAMS SPONSORED BY THE DEPARTMENT OF DEFENSE OR BRANCHES OF THE ARMED FORCES OF THE UNITED STATES AND THE FEASIBILITY OF ESTABLISHING A JUNIOR RESERVE OFFICER TRAINING CORPS PROGRAM IN EACH HIGH SCHOOL IN SOUTH CAROLINA.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    This resolution may be cited as the "South Carolina Junior Reserve Officer Training Corps Initiative."

SECTION    2.    (A)    There is created a Junior Reserve Officer Training Corps Study Committee composed of nine members charged with the duty and responsibility of studying the state and federal laws and procedures relating to establishing Junior Reserve Officer Training Corps programs in high schools and the feasibility of establishing at least one unit of the Junior Reserve Officer Training Corps at each high school in this State.

(B)    One member of the committee must be a person with a background in education appointed by the Governor from the State at large. The member appointed by the Governor is the chairman of the committee. One member of the committee is the Chairman of the Education Committee of the Senate, or his designee. One member of the committee is the Chairman of the Education and Public Works Committee of the House of Representatives, or his designee. One member of the committee is the President of The Citadel, or his designee, who must be a member of the faculty or staff of the college. One member of the committee is the Adjutant General of South Carolina or his designee who must be a member of the Military Department of South Carolina. One member of the committee is the State Superintendent of Education, or her designee, who must be appointed from among the full-time employees of the Department of Education.

The State Superintendent of Education shall appoint three additional members of the committee from the State at large. Of these three appointees, one must be a commissioned Junior Reserve Officer Training Corps instructor at a high school in South Carolina that has a successful Junior Reserve Officer Training Corps program, one must be the Superintendent of Education of a local school district, and one must be the principal of a high school.

Terms of committee members expire upon a change in the member's status that would have rendered the member ineligible for appointment to the committee at the time of his appointment or upon dissolution of the committee. Vacancies to the committee must be filled in the same manner as the original appointment. All members of the committee must be residents of South Carolina and shall serve until their successors are appointed.

(C)    The members of the committee are allowed mileage, per diem, and subsistence at the rates provided by law for members of committees and commissions and must be paid from funds appropriated to the Department of Education for mileage, per diem, and subsistence.

(D)    The committee or any subcommittee thereof appointed by the chairman may hold hearings, sit, and act at times and places within the State as the chairman designates. The committee shall report to the General Assembly by November 1, 2003, as to the feasibility of requiring the Department of Education, county boards of education, school districts, boards of trustees, and high schools in this State to apply to the Department of Defense or the Secretary of each of the branches of the Armed Forces of the United States, as appropriate, for the establishment of at least one unit of the Junior Reserve Officer Training Corps at each high school in South Carolina. The committee shall make recommendations concerning military training in high schools and may report on any special matters.

(E)    The Department of Education must provide the committee with the necessary staff, secretarial support, legal counsel, and material support from personnel employed by the department and supplies on hand without additional compensation or expense.

(F)    The committee is dissolved on January 31, 2004, unless reauthorized or continued by law.

SECTION    3.    This joint resolution takes effect upon approval by the Governor.
