A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-19-55 SO AS TO PROVIDE THAT THE STATE DEPARTMENT OF EDUCATION SHALL ESTABLISH A MANDATORY CONTINUING EDUCATION PROGRAM FOR SCHOOL BOARD TRUSTEES, TO PROVIDE THAT EACH TRUSTEE MUST ATTEND SIX HOURS OF CONTINUING EDUCATION ANNUALLY AND THAT INSTRUCTION ON THE FISCAL CONCERNS OF A SCHOOL DISTRICT MUST BE PART OF THE INSTRUCTION, AND TO PROVIDE THAT THE SCHOOL TRUSTEE CONTINUING EDUCATION PROGRAM MUST BE FUNDED BY THE STATE AND THE STATE DEPARTMENT OF EDUCATION MAY USE ITS OWN RESOURCES OR CONTRACT WITH PUBLIC OR PRIVATE ENTITIES TO CONDUCT THE PROGRAMS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 19, Title 59 of the 1976 Code is amended by adding:

"Section 59-19-55.    (A)    The State Department of Education shall establish a mandatory continuing education program for school board trustees in which each school board trustee is required to complete six hours of continuing education annually. As part of the curriculum, the program must include instruction on the fiscal concerns of a school district.

(B)    The continuing education program must be funded by the State. The State Department of Education may use its own resources or contract with public or private entities to conduct the programs."

SECTION    2.    This act takes effect upon approval by the Governor and the mandatory continuing education requirement begins on July 1, 2003.
