VERSIONS OF THIS BILL
TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 39-41-225 SO AS TO MAKE IT UNLAWFUL IN THIS STATE KNOWINGLY TO MANUFACTURE, BLEND, DISTRIBUTE, SELL, OR OFFER FOR SALE MOTOR FUEL CONTAINING METHYL TERTIARY BUTYL ETHER (MTBE) AND CERTAIN OTHER OXYGENATES AND TO DEFINE CERTAIN TERMS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 41, Title 39 of the 1976 Code is amended by adding:
"Section 39-41-225. (A) As used in this section:
(1) 'MTBE' means methyl tertiary butyl ether.
(2) 'Covered oxygenate' means any of the following:
(a) Ethyl tertiary butyl ether (ETBE);
(b) Diisopropyl ether (DIPE);
(c) Tert-amyl methyl ether (TAME);
(d) Methanol;
(e) N-proponal;
(f) N-butanol;
(g) Iso-propanol;
(h) Iso-butanol;
(i) Sec-butanol;
(j) Tert-butanol;
(k) Tert-pentanol or tert-amyl alcohol.
(3) 'Motor fuel' has the same meaning as in Section 12-28-110(39).
(B) Beginning January 1, 2008, it is unlawful for a person knowingly to manufacture, blend, distribute, sell, or offer for sale in this State motor fuel containing MTBE or a covered oxygenate.
(C) It is not a violation of this section to distribute, sell, or offer for sale motor fuel containing incidental amounts of MTBE or a covered oxygenate not to exceed one-half of one percent by volume.
(D) Nothing in this section prohibits the transport through this State of motor fuel containing MTBE or a covered oxygenate for delivery outside this State."
SECTION 2. This act takes effect upon approval by the Governor.
