A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 40-43-95 SO AS TO ESTABLISH REQUIREMENTS FOR A PHARMACIST LICENSED IN THIS STATE TO ADMINISTER VACCINES, INCLUDING TRAINING REQUIREMENTS, POLICIES AND PROCEDURES FOR ADMINISTERING VACCINES, RECORDKEEPING REQUIREMENTS, AND CONTINUING EDUCATION REQUIREMENTS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 43, Title 40 of the 1976 Code is amended by adding:

"Section 40-43-95.    (A)(1)    A pharmacist licensed in this State may administer vaccinations if the pharmacist successfully completes a training accredited by the Centers for Disease Control and Prevention (CDC) or the Accreditation Council on Pharmacy Education or a similar health authority or professional body approved by the board.

(2)    This training must include study materials and hands-on training and techniques for administering vaccines, must comply with current CDC guidelines, and must provide instruction and experiential training in the following content areas:

(a)    mechanisms of action for vaccines, contraindications, drug interactions, and monitoring after vaccine administration;

(b)    standards for pediatric, adolescent, and adult immunization practices;

(c)    basic immunology and vaccine protection;

(d)    vaccine preventable diseases;

(e)    recommended pediatric, adolescent, and adult immunization schedules;

(f)    vaccine storage management;

(g)    biohazard waste disposal and sterilization techniques;

(h)    informed consent;

(i)     physiology and techniques for vaccine administration;

(j)     prevaccine and postvaccine assessment and counseling;

(k)    immunization record management;

(l)     management of adverse events, including identification, appropriate response, documentation, and reporting;

(m)    reimbursement procedures and vaccine coverage by federal, state, and local entities.

(B)    In addition to satisfying the requirements of subsection (A), a pharmacist who administers vaccines shall:

(1)    maintain current cardiopulmonary resuscitation certification, also known as Basic Life Support, renewed as required by the American Heart Association or the American Red Cross;

(2)    have written policies and procedures in place for counseling, recordkeeping, aftercare, and mechanisms for adverse reactions;

(3)    before administering a vaccine:

(a)    counsel the patient or the patient's representative, or both, about contraindications;

(b)    provide in writing, in specific and readily understood terms, information on the risks and benefits of the vaccine;

(c)    provide the patient or the patient's representative, or both, with the current Vaccination Information Statement, as required by the CDC;

(d)    obtain a signed copy of the patient's consent to be vaccinated;

(4)    maintain the following documentation for not less than three years and this documentation must be available for inspection by the board:

(a)    patient's name, address, phone number, date of birth, and gender;

(b)    the prescription drug order, including any applicable collaborative pharmacy practice agreement;

(c)    date of the original prescription drug order;

(d)    medication or vaccine administered, expiration date, lot number, site of administration, and dose administered;

(e)    date of administration of the vaccine;

(f)    name of the pharmacist administering the dose;

(g)    signed copy of the patient's informed consent.

(C)    A pharmacist who administers vaccines shall, as part of continuing education required pursuant to Section 40-43-130(B), complete a minimum of two immunization-related continuing education credits approved by the Accreditation Council on Pharmacy Education."

SECTION    2.    This act takes effect upon approval by the Governor.
