A JOINT RESOLUTION

TO PROVIDE FOR AN ADVISORY REFERENDUM TO BE HELD AT THE SAME TIME AS THE 2018 GENERAL ELECTION TO DETERMINE WHETHER THE QUALIFIED ELECTORS OF GREENVILLE COUNTY FAVOR THE EXISTING GOVERNING STRUCTURE OF THE GREENVILLE HEALTH SYSTEM AND WHETHER THIS GOVERNING STRUCTURE MUST BE USED IN ALL CURRENT OR FUTURE ENTITIES THE GREENVILLE HEALTH SYSTEM CREATES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    (A)    An advisory referendum must be held at the same time as the 2018 general election in Greenville County on the question of whether the qualified electors of the county favor the existing governing structure of the Greenville Health System and whether it must be used in all current or future entities the Greenville Health System creates. The advisory referendum for this purpose must be conducted by the Greenville County Board of Voter Registration and Elections at the same time as the 2018 general election. The county board of voter registration and elections shall conduct and supervise the advisory referendum in the same manner governed by the election laws of this State, mutatis mutandis. The board shall frame the question for the ballot, prepare the necessary ballots, appoint managers for the voting precincts, and do all things necessary to carry out the advisory referendum, including the counting of ballots and declaring the results. The board shall advertise the date of the advisory referendum sixty days preceding it in a newspaper of general circulation in the county and shall publish a second notice thirty days before the advisory referendum. The cost of the advisory referendum must be paid by Greenville County.

(B)    The questions put before the qualified electors of the county at the 2018 advisory referendum read as follows:

"Do you favor the governance structure of the Greenville Health System where board members are appointed by the Greenville County Legislative Delegation, including six from designated areas appointed by the delegation upon nomination of members of the delegation representing those areas?

Those voting in favor of the question shall deposit a ballot with a check or cross mark in the square after the word 'Yes', and those voting against the question shall deposit a ballot with a check or cross mark in the square after the word 'No'."

"Do you believe that any current or future entities created by the Greenville Health System should have the same governance structure as that of the health system and if not, be considered by law to be unlawfully formed and null and void?

No    []

Those voting in favor of the question shall deposit a ballot with a check or cross mark in the square after the word 'Yes', and those voting against the question shall deposit a ballot with a check or cross mark in the square after the word 'No'."

SECTION    2.    This joint resolution takes effect upon approval by the Governor.
