Be it enacted by the General Assembly of the State of South Carolina: Disclaimer, explanation SECTION 1. Section 1 of Act 469 of 2000, as last amended by Act 166 of 2003, is further amended to read: "Section 1. (A) The boundaries of School District 1 in York County are not altered by the provisions of this act. These school district lines are as defined by law and any census blocks which may be divided are done so only for statistical purposes and to establish a population base. (B) '(P)' indicates a split census block where '(P1)' indicates all population assigned to School District No. 1, '(P2)' indicates all population assigned to School District No. 2 and '(P3)' indicates all population assigned to School District No. 3 for statistical purposes only." nonpartisan election by the qualified electors of the district with five members required to reside in and be elected by the qualified electors of each of the five districts delineated in subsection (A) of this section and two elected at large from the district without regard to residency. (2) The trustees representing districts 1, 3, and 5 and one at-large seat must be elected at the time of the general election of 2008, and the trustees presently residing in districts 2 and 4 and one at-large seat whose terms expire in 2006 must be elected at the time of the general election of 2006. The trustees serving on the effective date of this act, elected from residency districts 2 and 4 and the at-large seat shall continue to serve until the expiration of their terms in 2006. Thereafter, all terms of office are for four years, until their successors are elected and qualify. (3) Notwithstanding another provision of law, beginning with elections conducted in 1996, each candidate for election as a trustee to the school boards in York County School Districts 1, 2, 3, and 4 shall file his statement of candidacy with the Registration and Elections Commission for York County for the period beginning no earlier than 12:00 noon on August first and ending no later than 12:00 noon on August thirty-first. However, if either of these dates falls on a Saturday, Sunday, or legal holiday, the date is extended until 12:00 noon of the next succeeding day which is not a Saturday, Sunday, or legal holiday. (4) The balloting shall take place at the general election precincts located in the school district and conducted according to the laws and regulations governing elections, mutatis mutandis. In each election, those candidates receiving the most votes are declared elected and a run-off is not required. All newly-elected members of the board shall take office as provided in Section 59-19-315 of the 1976 Code. (5) If a seat becomes vacant before the expiration of the incumbent's term of office due to death, resignation, removal, or any other cause, the resulting vacancy must be filled by the board of trustees for the unexpired portion of the term until the next election for trustees is held."
