Be it enacted by the General Assembly of the State of South Carolina:

Delete coverage through the retirement system; coverage for county mental retardation boards

SECTION 1. Section 1-11-144 of the 1976 Code, as added by Act 73 of 1989, is amended to read:

"Section 1-11-144. The Budget and Control Board may provide health and dental insurance coverage to regional tourism promotion commissions funded by the Department of Parks, Recreation and Tourism and to county mental retardation boards funded by the State Mental Retardation Department under the State Health Insurance Plan. The employer may obtain coverage by applying to the board and by complying with the requirements established by the board. However, the benefits of the plan must be the same as those provided to state and school district employees. An employer electing to participate in the State Health Insurance Plan shall agree to participate for a minimum of two years. The board may adjust the premium rates during the coverage period based on experience."

SECTION 2. Section 9-1-440 of the 1976 Code is amended by adding at the end:

"A current contributing member of the system, who has prior service as a magistrate or an employee of a magistrate for which the only compensation was from fees, may elect to receive prior service credit for this service upon paying into the system the cost as provided by this section."

Time effective

SECTION 3. This act takes effect upon approval by the Governor.

Approved the 27th day of May, 1991.
