A Bill to amend Section 40-33-50, as amended, Code of Laws of South Carolina,
1976, relating to circumstances to which the requirements of nursing do not
apply, so as to include out-of-state nurses enrolled in an approved course or
experimental project; to amend Section 40-33-230, relating to State Board of
Nursing Compensation, so as to conform compensation provisions to other state
boards; to amend Section 40-33-260, as amended, relating to a board quorum, so
as to revise it to conform to the increased board size; to amend Section
40-33-910, as amended, relating to examinations, so as to provide that an
applicant must pass an examination prescribed rather than administered by the
Board; and to reauthorize the State Board of Nursing for six years.

AN ACT TO AMEND SECTION 40-33-50, AS AMENDED, CODE
OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO
CIRCUMSTANCES TO WHICH THE REQUIREMENTS OF NURSING
DO NOT APPLY, SO AS TO INCLUDE OUT-OF-STATE NURSES
ENROLLED IN AN APPROVED COURSE OR EXPERIMENTAL
PROJECT; TO AMEND SECTION 40-33-230, RELATING TO STATE
BOARD OF NURSING COMPENSATION, SO AS TO CONFORM
COMPENSATION PROVISIONS TO OTHER STATE BOARDS; TO
AMEND SECTION 40-33-260, AS AMENDED, RELATING TO A
BOARD QUORUM, SO AS TO REVISE IT TO CONFORM TO THE
INCREASED BOARD SIZE; TO AMEND SECTION 40-33-910, AS
AMENDED, RELATING TO EXAMINATIONS, SO AS TO PROVIDE
THAT AN APPLICANT MUST PASS AN EXAMINATION
PRESCRIBED RATHER THAN ADMINISTERED BY THE BOARD;
AND TO REAUTHORIZE THE STATE BOARD OF NURSING FOR
SIX YEARS.
Be it enacted by the General Assembly of the State of South Carolina:
Chapter not applicable
SECTION 1. Section 40-33-50 of the 1976 Code, as last amended by Act
114 of 1987, is further amended by adding at the end:
"(8) As prohibiting the practice of nursing by a licensed nurse of
another state or country who is enrolled in a board-approved course of
study or board-approved experimental project requiring nursing practice as
a part of the educational program."
Board member compensation
SECTION 2. Section 40-33-230 of the 1976 Code is amended to read:
"Section 40-33-230. A board member may receive for board
service the usual per diem, mileage, and subsistence as provided by law for
members of state boards for each day actually engaged in the duties of the
office. These expenses must be paid from the fees received by the board
under this chapter."
Meetings; quorum
SECTION 3. Section 40-33-260 of the 1976 Code, as last amended by Act
114 of 1987, is further amended to read: "Section 40-33-260. The board shall meet at least quarterly for
the purpose of transaction of business.
Five members of the board constitute a quorum, but no action of the
board is valid unless authorized by the affirmative vote of a majority of the
members present."
Examinations
SECTION 4. Section 40-33-910 of the 1976 Code, as last amended by Act
114 of 1987, is further amended to read:
"Section 40-33-910. An applicant must pass the examinations
prescribed by the board in subjects as may be determined by the
board."
Board reauthorized
SECTION 5. In accordance with Section 1-20-60 of the 1976 Code the
existence of the State Board of Nursing is reauthorized for six years.
Time effective
SECTION 6. This act takes effect upon approval by the Governor.
