A BILL

TO AMEND SECTION 12-45-90, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO MEDIA FOR PAYMENT OF PROPERTY TAXES, SO AS TO ALLOW PAYMENT OF PROPERTY TAXES BY CREDIT CARD AND TO DELETE OBSOLETE METHODS OF PAYMENT.

Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 12-45-90 of the 1976 Code is amended to read:

"Section 12-45-90. (A) Taxes shall be are payable in the following kinds of funds by the following methods and no other: silver coin, United States currency and not more than five dollars in United States coins, United States postal money orders, and checks subject to collection. Jury certificates and per diem of witnesses in the circuit court and all county claims which have been approved and certificates issued by the governing body of the county in which such services were rendered or such claims approved, not including school taxes. The receiving official may elect to accept more than five dollars in coins.

(B) In addition to the methods of payment provided in subsection (A), the governing body of the county may elect to accept payment of property taxes by credit card. If a municipality or other political subdivision collects its own property taxes, the governing body of that governmental entity may elect to accept credit card payments of property taxes. If any political subdivision elects to accept credit card payment of property taxes, no discounting of the property taxes to pay fees associated with accepting credit card payments is permissible."

SECTION 2. This act takes effect upon approval by the Governor.
