A Bill to amend Chapter 7 of Title 5, Code of Laws of South Carolina, 1976,
relating to organization, functions, and responsibilities of municipalities,
by adding Section 5-7-155 so as to provide that if any width of a street or
highway is within the boundary of a municipality, the remaining portion of the
street or highway not within the municipal boundary but touching the boundary
is nevertheless considered to be within the boundary of that municipality for
purposes of its police jurisdiction.

AN ACT TO AMEND CHAPTER 7 OF TITLE 5, CODE OF LAWS OF SOUTH CAROLINA, 1976,
RELATING TO ORGANIZATION, FUNCTIONS, AND RESPONSIBILITIES OF MUNICIPALITIES, BY
ADDING SECTION 5-7-155 SO AS TO PROVIDE THAT IF ANY WIDTH OF A STREET OR HIGHWAY
IS WITHIN THE BOUNDARY OF A MUNICIPALITY, THE REMAINING PORTION OF THE STREET OR
HIGHWAY NOT WITHIN THE MUNICIPAL BOUNDARY BUT TOUCHING THE BOUNDARY IS
NEVERTHELESS CONSIDERED TO BE WITHIN THE BOUNDARY OF THAT MUNICIPALITY FOR
PURPOSES OF ITS POLICE JURISDICTION.
Be it enacted by the General Assembly of the State of South Carolina:
Police jurisdiction over certain streets and highways
SECTION 1. Chapter 7 of Title 5 of the 1976 Code is amended by adding:
"Section 5-7-155. If any portion of a street or highway is within the
boundary of a municipality, the remaining width of the street or highway not
within the municipal boundary but touching the boundary is nevertheless
considered to be within the boundary of that municipality for purposes of its
police jurisdiction."
Time effective
SECTION 2. This act takes effect upon approval by the Governor. |
