A Bill to amend the Code of Laws of South Carolina, 1976, by adding Section
59-1-456 so as to provide that the use of public school and school-district
equipment and supplies by school or school district faculty, staff, or
students to lobby any state official or agency, including the General
Assembly, or any political subdivision of the State is prohibited, provide
exceptions, and provide for related matters.

A BILL
TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA,
1976, BY ADDING SECTION 59-1-456 SO AS TO PROVIDE
THAT THE USE OF PUBLIC SCHOOL AND
SCHOOL-DISTRICT EQUIPMENT AND SUPPLIES BY
SCHOOL OR SCHOOL DISTRICT FACULTY, STAFF, OR
STUDENTS TO LOBBY ANY STATE OFFICIAL OR AGENCY,
INCLUDING THE GENERAL ASSEMBLY, OR ANY
POLITICAL SUBDIVISION OF THE STATE IS PROHIBITED,
PROVIDE EXCEPTIONS, AND PROVIDE FOR RELATED
MATTERS.
Be it enacted by the General Assembly of the State of South
Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 59-1-456. (A) Notwithstanding any other
provision of law, the use of public school and school-district
equipment and supplies, including specifically, but not limited to,
school and school district stationery and electronic communications,
such as computer e-mail and electronic facsimile transmissions, by
school or school district faculty, staff, or students to lobby any state
official or agency, including the General Assembly or any member
of it, or any political subdivision of the State is prohibited.
(B) Nothing in this section shall be construed to prohibit a
public school principal or school district superintendent or board
member from using school or school district stationery or electronic
communications such as computer e-mail and electronic facsimile
transmissions to contact a state official or agency, including the
General Assembly or any member of it, or any political subdivision
of the State to express an opinion or request action with regard to
any legislation, regulation, ordinance, ruling, order, resolution, or
other official action or decision of the state agency, official, or
political subdivision so long as the approval of the school district
governing board or the political subdivision which appropriates the
school district's annual budget is secured."
SECTION 2. This act takes effect upon approval by the
Governor.
