A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 8-11-675 SO AS TO PROVIDE THAT STATE AGENCIES OR DEPARTMENTS HAVING EMPLOYEES LOCATED WITHIN THOSE COUNTIES WHOSE PLACE OF EMPLOYMENT IS CLOSED BY THE GOVERNOR BECAUSE OF EXTREME WEATHER OR OTHER EMERGENCY CONDITIONS MAY NOT REQUIRE THOSE EMPLOYEES TO MAKE UP TIME LOST FROM WORK, TO PROVIDE THAT EMPLOYEES OF THE STATE OF SOUTH CAROLINA LOCATED WITHIN THOSE COUNTIES WHOSE PLACE OF EMPLOYMENT IS CLOSED BY THE GOVERNOR AS A RESULT OF EXTREME WEATHER OR OTHER EMERGENCY CONDITIONS ARE NOT REQUIRED UNDER THE HAZARDOUS WEATHER POLICY TO MAKE UP TIME LOST FROM WORK, AND TO PROVIDE FOR COMPENSATORY TIME FOR CERTAIN EMPLOYEES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 8-11-675. (A) An agency or a department of the State of South Carolina having employees located within those counties whose place of employment is closed by the Governor because of extreme weather or other emergency conditions may not require an employee to comply with hazardous weather and emergency leave policies adopted by the State Budget and Control Board, for time lost from work as a result of extreme weather or other emergency conditions.

(B) An employee of the State of South Carolina located within those counties whose place of employment is closed by the Governor because of extreme weather or other emergency conditions is not required to comply with the provisions of hazardous weather and emergency leave policies adopted by the State Budget and Control Board, and make up time lost from work as a result of extreme weather or other emergency conditions.

(C) An employee who meets the provisions of subsection (B) and has already worked to make up for lost time is entitled to compensatory leave time under State Human Resources regulations as adopted by the State Budget and Control Board."

SECTION 2. This act takes effect upon approval by the Governor and is effective beginning for those employees whose places of employment of an agency or a department of the State of South Carolina are closed by the Governor because of extreme weather or emergency conditions after September 13, 1999.
