A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-150-385 SO AS TO ESTABLISH THE BROADENING UNIVERSITY IMPROVEMENTS TO LIFE DIVERSITY FUND (BUILD) USING MONIES FROM THE EDUCATION LOTTERY ACCOUNT FOR THE PURPOSE OF PROVIDING GRANTS TO PRIVATE HISTORICALLY BLACK COLLEGES AND UNIVERSITIES TO BE USED FOR MAINTENANCE, REPAIR, RENOVATION, AND IMPROVEMENT OF CAPITAL FACILITIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    The 1976 Code is amended by adding:

    "Section 59-150-385.    (A)    There is established the Broadening University Improvements to Life Diversity Fund (BUILD) for the purpose of providing grants to private historically black colleges and universities to be used for maintenance, repair, renovation, and improvement of capital facilities.

    (B)    The fund must be funded annually by appropriations from the Education Lottery Account in an amount provided by the General Assembly, but not less than five million dollars annually.

    (C)    The Commission on Higher Education must certify the eligibility of schools seeking grants pursuant to this section. A school must submit an annual list of capital facility needs to the commission to be considered for eligibility for funding. The commission must distribute grants in an equal amount per capita to each school certified pursuant to this section.

    (D)    The commission must promulgate regulations and establish procedures to administer the provisions of this section.

    (E)    For purposes of this section, historically black college and university has the meaning given the term in 20 U.S. Code Section 1061, as amended."

SECTION    2.    This act takes effect upon approval by the Governor.
