A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING ARTICLE 22, CHAPTER 1 TO TITLE 1 SO AS TO REQUIRE, UPON EXECUTIVE ORDER OF THE GOVERNOR, THE POW/MIA FLAG TO BE FLOWN AT SOUTH CAROLINA REST AREAS AND AT OTHER LOCATIONS THAT THE GOVERNOR MAY ORDER WHEN THE UNITED STATES IS ENGAGED IN WARTIME MILITARY OPERATIONS AND MEMBERS OF THE ARMED FORCES ARE PRISONERS OF WAR OR MISSING IN ACTION, ON CERTAIN NATIONAL HOLIDAYS, AND AT OTHER TIMES AS THE GOVERNOR MAY ORDER.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 1, Title 1 of the 1976 Code is amended by adding:

"Article 22

POW/MIA Flag

Section 1-1-1710.    Upon executive order of the Governor, the POW/MIA flag, recognized in 1990 by the 101st Congress in U. S. Public Law 101-355, must be flown at all South Carolina rest areas and at other locations as the Governor may require in his order:

(1)    when the United States is engaged in wartime military operations and any member of the armed forces serving in such operations is identified as a 'prisoner of war' or 'missing in action';

(2)    on the following national holidays:

(a)    Armed Forces Day;

(b)    Memorial Day;

(c)    Flag Day;

(d)    Independence Day;

(e)    National POW/MIA Recognition Day;

(f)    Veteran's Day;

(3)    other times as the Governor, by executive order, may require."

SECTION    2.    This act takes effect upon approval by the Governor.
