To whom was referred a Bill (H. 3629) to amend Section 40-19-200, relating to penalties for violating regulations of embalmers and funeral directors, so as to increase the minimum fine to one thousand dollars, etc., respectfully

EXPLANATION OF IMPACT:

Enactment would have no impact on the General Fund of the State, or on federal and/or other funds.

LOCAL GOVERNMENT IMPACT:

Enactment would have little or no impact on local government expenditures.

SPECIAL NOTES:

The Board of Economic Advisors is the appropriate entity to address any revenue impact associated with this bill.

A BILL

TO AMEND SECTION 40-19-200, RELATING TO PENALTIES FOR VIOLATING REGULATIONS OF EMBALMERS AND FUNERAL DIRECTORS, SO AS TO INCREASE THE MINIMUM FINE TO ONE THOUSAND DOLLARS AND TO INCREASE THE MAXIMUM FINE TO FIVE THOUSAND DOLLARS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 40-19-200 of the 1976 Code is amended to read:

"Section 40-19-200.    A person who practices or offers to practice funeral service in this State in violation of this chapter or who knowingly submits false information for the purpose of obtaining to obtain a license is guilty of a misdemeanor and, upon conviction, must be fined not less than five hundred one thousand dollars or more than twenty-five hundred five thousand dollars or imprisoned for not more than six months, or both."

SECTION    2.    This act takes effect upon approval by the Governor.
