A Bill to amend Section 2-1-60, as amended, Code of Laws of South Carolina,
1976, relating to the apportionment of the membership of the Senate into
specified senatorial districts, so as to alter and reapportion the districts
effective for the 1984 elections, to amend Act 257 of 1983, relating to the
apportionment of the membership of the Senate into specified senatorial
districts, so as to provide for an election schedule in order to insure that
members of the State Senate will be elected in the general election on
November 6, 1984, to authorize the State Election Commission to print separate
ballots for the state senatorial election, and to do all other acts necessary
to accomplish the intent of this Act.

AN ACT TO AMEND SECTION 2-1-60, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE APPORTIONMENT OF THE MEMBERSHIP OF THE SENATE INTO SPECIFIED SENATORIAL DISTRICTS, SO AS TO ALTER AND REAPPORTION THE DISTRICTS EFFECTIVE FOR THE 1984 ELECTIONS, TO AMEND ACT 257 OF 1983, RELATING TO THE APPORTIONMENT OF THE MEMBERSHIP OF THE SENATE INTO SPECIFIED SENATORIAL DISTRICTS, SO AS TO PROVIDE FOR AN ELECTION SCHEDULE IN ORDER TO INSURE THAT MEMBERS OF THE STATE SENATE WILL BE ELECTED IN THE GENERAL ELECTION ON NOVEMBER 6, 1984, TO AUTHORIZE THE STATE ELECTION COMMISSION TO PRINT SEPARATE BALLOTS FOR THE STATE SENATORIAL ELECTION, AND TO DO ALL OTHER ACTS NECESSARY TO ACCOMPLISH THE INTENT OF THIS ACT.
Be it enacted by the General Assembly of the State of South Carolina:
Legislative intent
SECTION 1. It is the intent of the General Assembly by this act to insure that state Senate elections scheduled bylaw for November 6, 1984, are conducted on that date based on the plan of representation provided in Section 2-1-60 of the 1976 Code, as amended by the provisions of this act.
It is further the intent of the General Assembly to insure regularly scheduled state Senate elections by providing in this act a special electoral schedule applicable only for 1984 state Senate elections.
Single member senatorial election districts
SECTION 2. Section 2-1-60 of the 1976 Code, as last amended by Act 257 of 1983, is further amended to read:
"Section 2-1-60. Effective with the 1984 elections, the State of South Carolina is divided into the following senatorial districts from which one senator must be elected:

Each Senate office shall constitute a separate and distinct office to which a separate number must be assigned. A candidate for the office of Senator must be a legal resident of the district in which he is a candidate.
The election ballots for the office of Senator in each district shall reflect the number assigned to each Senate office and the names of the candidates for each."
Schedule of election for 1984 only
SECTION 3. Act 257 of 1983 is amended by adding:
"Section 3A. (A) Notwithstanding any other provision of law and for the purposes of conducting state Senate elections scheduled for the general election November 6, 1984, only, the following election schedule shall apply:
(1) Candidates must file commencing at 12:01 p.m. August 13, 1984, and closing at twelve o'clock noon on August 15, 1984.
(2) Any primary election must be held on September 4, 1984.
(3) Any runoff election must be held on September 18, 1984.
(4) Any protest must be heard not later than twelve o'clock noon on September 24, 1984.
(5) Petition candidates will be placed on the ballot if the petition is filed not later than twelve o'clock noon on September 18, 1984.
(6) Candidates must be certified at twelve o'clock noon on October 1, 1984.
(7) Absentee ballots may be requested from the county registration board for the county of the voter's residence promptly after the filing cutoff date of August 15, 1984, and the certification date of October 1, 1984. Completed applications must be returned to the county registration board in person or by mail before 5:00 p.m. on the fourth day preceding the day of the election; provided, however, that applications must be accepted by the county board of registration until 5:00 p.m. on the day immediately preceding the election for those who appear in person and are qualified to vote absentee pursuant to items (4) and (7) of Section 7-15-320 of the 1976 Code. Absentee ballots, where possible, must be mailed to any qualified elector requesting an application in sufficient time to be completed and returned to the county registration board in person or by mail before 5:00 p.m. on the date of the election. All valid absentee ballots which are received in compliance with the provisions of this subsection must be counted in the election for which submitted.
(B) The State Election Commission is authorized to print separate ballots for the state senatorial election as provided in this section and to do all acts necessary in order to accomplish the intent of this act. Except as provided in this section, the state election laws shall apply, mutatis mutandis."
Time effective
SECTION 4. This act shall take effect upon approval by the Governor. |
