H 3850 General Bill, By H.C. Granger and T.M. Burriss
A Bill to amend Section 41-27-370, as amended, Code of Laws of South Carolina,
1976, relating to the definition of "unemployed" for the purposes of the South
Carolina Employment Security Law, so as to provide for certain pension
reductions on a pro-rata basis to conform to the Federal Unemployment Tax Act
and to prevent claimants from receiving both unemployment benefits and
vacation pay when more than two weeks of vacation are provided by the
employer; to amend Section 41-27-380, as amended, relating to the definition
of "wages", so as to provide that the term "wages" shall not include domestic
service in a private home of the employer; to amend Section 41-31-60, as
amended, relating to contribution rates on delinquent reports, so as to
express such rates verbally rather than numerically; to amend Section
41-35-120, as amended, relating to disqualification for benefits , so as to
prohibit the disqualification of certain recipients who are enrolled in
approved training activities; to amend Article 1, Chapter 35, Title 41, by
adding Section 41-35-140 so as to allow child support obligations to be
withheld from unemployment benefits ; to amend Section 41-35-310, relating to
an extended benefit period, so as to delete references to the National Trigger
Rate; to repeal Section 41-35-320, relating to national "on" and "off"
indicators; to amend Section 41-35-330, as amended, relating to state "on" and
"off" indicators, so as to change certain percentages therein; to amend
Section 41-35-340, relating to the definition of the "rate of insured
unemployment", so as to revise such definition; to amend Section 41-35-420, as
amended, relating to eligibility for extended benefits , so as to further
provide for an individual's eligibility for such benefits ; to amend Section
41-35-440, relating to the total extended benefit amount, so as to permit such
amount to be reduced under certain conditions; to amend Section 41-35-450,
relating to the announcement by the Employment Security Commission of "on" and
"off" indicators, so as to delete references to the National Trigger Rate; and
to amend Section 41-39-20, which prohibits the assignment, pledge, or
encumbrance of unemployment benefits , so as to allow such benefits to be
subject to attachment for the purpose of paying child support obligations.
