South Carolina, 1976, relating to elections, so as to delete the provisions
which allow straight party ticket voting from general election ballots,
straight party ticket voting on any type of vote recorder, and voting for all
of the candidates of one party by use of a voting machine.

A BILL
TO AMEND SECTIONS 7-13-330, 7-13-1340, AND 7-13-1640, CODE
OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO
ELECTIONS, SO AS TO DELETE THE PROVISIONS WHICH
ALLOW STRAIGHT PARTY TICKET VOTING FROM GENERAL
ELECTION BALLOTS, STRAIGHT PARTY TICKET VOTING ON
ANY TYPE OF VOTE RECORDER, AND VOTING FOR ALL OF
THE CANDIDATES OF ONE PARTY BY USE OF A VOTING
MACHINE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. That portion of Section 7-13-330 of the 1976 Code
entitled "INSTRUCTIONS" is amended to read:
"INSTRUCTIONS--To vote a straight party ticket, make a
cross (X) in the circle (O) under the name of your party. Nothing further
need or should be done. To vote a mixed ticket, or in other words for
candidates of different parties, omit making a cross (X) mark in the party
circle at the top and make Make a cross (X) in the voting
square [] opposite the name of each candidate on the ballot for whom
you wish to vote. If you wish to vote for a candidate not on any ticket,
write or place the name of such the candidate on your
ticket opposite the name of the office. Before leaving the booth, fold the
ballot so that the initials of the manager may be seen on the outside.

SECTION 2. Section 7-13-1340(b) of the 1976 Code is amended
to read:
"(b) It shall permit each elector, at
other than primaries, to vote a straight party or body ticket, with the
exception of candidates for the offices of presidential electors, in
one operation; and, in one operation, to vote for all the
candidates of one party or body for presidential electors; and, in one
operation, to vote for all the candidates of one party or body for every
office to be voted for, except those offices as to which he votes for
individual candidates and the offices of presidential electors;".
SECTION 3. Section 7-13-1640(1) of the 1976
Code is amended to read:
"(1) Provide facilities for voting for
all candidates of as many political parties or organizations as may make
nominations of candidates at any an election, for or
against as many questions as may be submitted at any
an election and, at all general or special elections, permit the
voter to vote for all of the candidates of one party or in part for the
candidates of one or more parties;".
SECTION 4. This act takes effect upon
approval by the Governor.
