TO REQUIRE A BINDING REFERENDUM TO BE PLACED ON THE BALLOT OF CHARLESTON COUNTY AT THE GENERAL ELECTION OF 2000 REQUIRING VOTERS TO CHOOSE WHETHER THE CHARLESTON COUNTY PUBLIC SCHOOL SYSTEM MUST BE GOVERNED BY INDEPENDENT COMMUNITY SCHOOL DISTRICTS OR BY A CENTRALIZED COUNTYWIDE SCHOOL BOARD.

Whereas, many plans have been entertained to revise the governance of the Charleston County public school system; and

Whereas, the complexities of the issue have made consensus difficult to reach; and

Whereas, the Charleston County Legislative Delegation endeavors, by this joint resolution, to ascertain the wishes of a majority of those voting in the general election of 2000; and

Whereas, it is the intent of the members of the delegation to introduce legislation to implement the wishes of the majority of those voting in the general election. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. (A) At the general election in 2000, the following referendum must be placed on the ballot in Charleston County and voters must select one only:

(1) The current Charleston County public school system must be reformed into as many as seven independent community school districts with their own elected at-large school boards with certain student, administrative, and school building needs supplied centrally.

(2) The current Charleston County public school system must be reformed by eliminating the constituent school districts and school boards and all school authority and administration then centralized in one nine-member countywide school board with six members elected from single-member districts.

(B) The state election laws apply to this process, mutatis mutandis, and the results of this referendum are binding.

SECTION 2. This joint resolution takes effect upon approval by the Governor.
