AN ACT TO AMEND SECTION 2-1-60, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE APPORTIONMENT OF MEMBERS OF THE SENATE INTO SPECIFIED SENATORIAL DISTRICTS, SO AS TO ALTER AND REAPPORTION SUCH DISTRICTS EFFECTIVE WITH THE 1984 ELECTIONS, TO REPEAL SECTION 2-1-70, RELATING TO RESIDENCE REQUIREMENTS FOR SENATORS IN MULTI-COUNTY DISTRICTS AND TO REPEAL SECTIONS 7-21-30 AND 7-21-40, RELATING TO CERTAIN OBSOLETE PROVISIONS PERTAINING TO SENATORIAL DISTRICT SEATS. A candidate for the office of Senator must be a legal resident of the district in which he is a candidate. The election ballots for the office of Senator in each district shall reflect the number assigned to each Senate office and the names of the candidates for each." Existing districts effective until 1984 elections SECTION 2. The senatorial districts in existence on the effective date of this act shall continue in effect until the 1984 elections and the senatorial representation from those districts shall remain the same until the Monday following the 1984 general election. Counsel designated SECTION 3. The Senate of South Carolina hereby designates its counsel as the "appropriate official" referenced in 42 U.S.C. 1973c, Section 5 of the Voting Rights Act of 1965 as amended, hereinafter referred to as Section 5, to act in its behalf for the purposes of enforcing this act. The Senate of South Carolina, through its counsel, shall in compliance with Section 5 submit this act to the Attorney General of the United States prior to its enforcement. In the alternative, the Senate shall, through its counsel and pursuant to Section 5, seek a declaratory judgment in the District Court for the District of Columbia that this act has neither discriminatory intent nor effect and may therefore be enforced. Repeal SECTION 4. Sections 2-1-70, 7-21-30, and 7-21-40 of the 1976 Code are repealed. Time effective SECTION 5. This act shall take effect upon approval by the Governor. |
