A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-73-Previous459Next SO AS TO PROVIDE FOR INSURANCE RATING TERRITORIES FOR PRIVATE PASSENGER AUTOMOBILES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 38-73-Previous459. (A) Automobile insurers shall classify and rate private passenger automobiles owned or leased under a long term contract by an individual, by two or more relatives residing in the same household, or by husband and wife residing in the same household in accordance with rating territories prescribed in this section. In determining applicable rating territories, a private passenger automobile must be assigned to the county in which it principally is garaged.

(B) The number of the rating territories required to be used by automobile insurers as determined by county are:

(1) 1: Richland and Lexington counties;

(2) 2: Greenville County;

(3) 3: Spartanburg County;

(4) 4: Charleston County;

(5) 5: Aiken and Barnwell counties;

(6) 6: Abbeville, Anderson, Edgefield, Greenwood, Laurens, McCormick, and Oconee counties;

(7) 7: Allendale, Bamberg, Beaufort, Berkeley, Chesterfield, Colleton, Darlington, Dillon, Dorchester, Florence, Hampton, Horry, Jasper, Marion, and Marlboro counties;

(8) 8: Calhoun, Cherokee, Chester, Clarendon, Fairfield, Georgetown, Kershaw, Lancaster, Lee, Newberry, Orangeburg, Pickens, Saluda, Sumter, Union, Williamsburg, and York counties."

SECTION 2. This act takes effect July 1, 1992, and applies to automobile insurance rates filed after June 30, 1992.
