A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 57-3-45 SO AS TO ESTABLISH THE MASS TRANSIT ADVISORY COUNCIL AND PROVIDE FOR ITS MEMBERSHIP AND FUNCTIONS AND TO AMEND SECTION 12-28-2725, RELATING TO THE PORTION OF THE MOTOR FUELS USER FEE USED FOR MASS TRANSIT, SO AS TO PROVIDE THAT REVENUE EQUAL TO TWO CENTS A GALLON OF THE TOTAL USER FEE ON GASOLINE MUST BE USED FOR MASS TRANSIT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 3, Title 57 of the 1976 Code is amended by adding:

"Section 57-3-45.    (A)    There is established the Mass Transit Advisory Council to advise the Deputy Director for Mass Transit for the Department of Transportation on the mass transit needsNext and the specialized transportation PreviousneedsNext of all areas of the State. The Deputy Director for Mass Transit shall coordinate the activities of the council and call it's first meeting, at which time it shall elect officers and establish a regular schedule of meetings designed to assist the deputy director in obtaining the widest representation of views on the state's mass transit PreviousneedsNext. Members of the council shall serve without compensation, but are allowed the mileage, subsistence, and per diem allowed members of state boards, committees, and commissions, to be paid from approved accounts of the Department of Transportation.

(B)    The council membership consists of:"

SECTION    2.    Section 12-28-2725 of the 1976 Code, as last amended by Act 164 of 2005, is further amended to read:

"Section 12-28-2725.    Of the ten and thirty-four hundredths cents user fee on gasoline imposed pursuant to this chapter, an amount equal to twenty- five hundredths of a cent on each gallon must be used by the department for mass transit. There must be used by the department for mass transit Previousneeds an amount of the total revenue of the motor fuel user fee imposed on gasoline pursuant to this chapter equal to two cents a gallon.

The State Auditor annually shall audit, or cause to be audited, the state's regional transit authorities and eleemosynary organizations acting as regional transit authorities receiving funds from the Department of Transportation. Copies of the audits must be made available to the department and to the General Assembly."

SECTION    3.    This act takes effect July 1, 2007.
