AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 23-1-145, SO AS TO PROVIDE THAT EMPLOYEES OF COUNTY AND MUNICIPAL PRISON FACILITIES SHALL HAVE THE STATUS OF PEACE OFFICERS WHILE THEY ARE CONTROLLING, TRANSPORTING OR RECAPTURING ANY PRISONER IN THIS STATE.

Be it enacted by the General Assembly of the State of South Carolina:

Prison officials-peace officers

Section 1. The 1976 Code is amended by adding:

"Section 23-1-145. Employees of any county or municipal jail, prison, work camp or overnight lockup facility, while performing their officially assigned duties relating to the custody, control, transportation or recapture of any inmate or prisoner in this State, shall have the status of peace officers any where in the State in any matter relating to the custody, control, transportation or recapture of such inmate or prisoner. Provided, that for the purposes of this section no trustee shall be considered an employee."

Time Effective

Section 2. This act shall take effect upon approval of the Governor.
