AN ACT TO AMEND SECTION 56-5-3660, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO REQUIRED HELMETS FOR OPERATORS OR PASSENGERS OF TWO-WHEELED MOTORIZED VEHICLES AND SECTION 56-5-3670, RELATING TO REQUIRED GOGGLES OR FACE SHIELDS FOR OPERATORS OR PASSENGERS OF TWO-WHEELED MOTORIZED VEHICLES, SO AS TO ONLY REQUIRE SUCH HELMETS AND GOGGLES FOR OPERATORS OR PASSENGERS UNDER TWENTY-ONE YEARS OF AGE.
Be it enacted by the General Assembly of the State of South Carolina:
Persons under the age of twenty-one required to wear helmets
Section 1. Section 56-5-3660 of the 1976 Code is amended by inserting after "person" on line one "under the age of twenty-one".
The section when amended shall read:
"Section 56-5-3660. It shall be unlawful for any person under the age of twenty-one to operate or ride upon a two-wheeled motorized vehicle unless he wears a protective helmet of a type approved by the South Carolina Department of Highways and Public Transportation. Such a helmet must be equipped with either a neck or chin strap and be reflectorized on both sides thereof. The Department is hereby authorized to adopt and amend regulations covering the types of helmets and the specifications therefor and to establish and maintain a list of approved helmets which meet the specifications as established hereunder."
Persons under the age of twenty-one required to wear goggles
Section 2. Section 56-5-3670 of the 1976 Code is amended by inserting after "person" on line one "under the age of twenty-one".
The section when amended shall read:
"Section 56-5-3670. It shall be unlawful for any person under the age of twenty-one to operate a two-wheeled motorized vehicle unless he wears goggles or a face shield of a type approved by the South Carolina Department of Highways and Public Transportation. The Department is hereby authorized to adopt and amend regulations covering types of goggles and face shields and the specifications therefor and to establish and maintain a list of approved goggles and face shields which meet the specifications as established hereunder."
Time effective
Section 3. This act shall take effect upon approval by the Governor.
