AN ACT TO AUTHORIZE THE TRANSFER OF TITLE TO CERTAIN STREETS TO THE CITY OF COLUMBIA.
Be it enacted by the General Assembly of the State of South Carolina:
Legislative findings
Section 1. The General Assembly finds that many streets in the original street layout of the City of Columbia, established pursuant to state law, have been conveyed to the City of Columbia in the past for implementation of public projects. It further appears to the General Assembly that a planned relocation of railroads within the city will affect streets over the entire city as set forth in a resolution of the Columbia City Council adopted on November 4, 1981, which requests transfer of all remaining streets of the city in which the State of South Carolina may have an interest in order that the City of Columbia may better serve the public interest.
Interest in streets vested in City of Columbia
Section 2. All right, title, and interest which the State of South Carolina may have to all streets in the City of Columbia in the area bounded on the north by the northern right-of-way of Elmwood Avenue, on the east by the eastern right-of-way of Harden Street, on the south by the southern right-of-way of Heyward Street, and on the west by the Broad and Congaree Rivers, is hereby vested in and transferred to the City of Columbia. The City of Columbia may close, relocate, and convey for private reuse any portion of such streets not needed for public use at the discretion of Columbia City Council.
Provided, nothing in this act is intended to remove from the South Carolina Department of Highways and Public Transportation any right, title, or interest it may have in streets within the state highway system in the affected areas.
Time effective
Section 3. This act shall take effect upon the approval by the Governor.
