AN ACT TO AMEND ACT 245 OF 1983, RELATING TO BUDGETS OF SCHOOL DISTRICTS IN ORANGEBURG COUNTY, SO AS TO EXTEND THE PROVISIONS OF THE ACT TO INCLUDE THE SCHOOL YEAR 1985-86 AND TO REQUIRE A REFERENDUM BEFORE A MILLAGE INCREASE OF MORE THAN FIVE MILLS MAY BE MADE IN ANY DISTRICT.
Be it enacted by the General Assembly of the State of South Carolina:
Board of trustees to prepare budget
SECTION 1. Section 1 of Act 245 of 1983 is amended to read:
"Section 1. The Board of Trustees of each of the school districts in Orangeburg County, on or before the last day of June of 1985, shall prepare a school district budget for the ensuing school year. On or before the first day of September of 1985 each board of trustees shall notify the county auditor and treasurer in writing of the millage required for the operation of the schools in their respective districts for the 1985-1986 school year. The notice by each board constitutes authority for the levying and collection of the millage upon all of the real and personal property within the respective school district. The levy must be placed to the credit of the district in which it is levied and expended within that district only. No district may raise its millage by more than five mills unless a majority of the registered electors of the district voting in a referendum called by the district Board of Trustees and conducted by the County Election Commission, vote in favor of the millage increase budget becoming effective."
Time effective
SECTION 2. This act shall take effect upon approval by the Governor.
