AN ACT TO AMEND SECTION 56-5-2945, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE FELONY OFFENSE OF CAUSING BODILY INJURY OR DEATH WHILE DRIVING A VEHICLE UNDER THE INFLUENCE OF DRUGS OR ALCOHOL, SO AS TO PROVIDE A MANDATORY THREE-YEAR DRIVER'S LICENSE SUSPENSION, PLUS ANY TERM OF IMPRISONMENT FOR THE PERSON CONVICTED OF THE OFFENSE.

Be it enacted by the General Assembly of the State of South Carolina:

Driver's license suspension for operating vehicle under influence

SECTION 1. Section 56-5-2945 of the 1976 Code is amended by adding at the end:

"The South Carolina Department of Highways and Public Transportation shall suspend the driver's license of any person who is convicted or who receives sentence upon a plea of guilty or nolo contendere pursuant to this section for a period to include any term of imprisonment plus three years."

Driver's license suspension effective date

SECTION 2. The amendment to Section 56-5-2945 of the 1976 Code contained in this act is effective with respect to convictions or guilty or nolo contendere pleas entered after the effective date of this act.

Time effective

SECTION 3. This act takes effect upon approval by the Governor.
